These Terms and Conditions of Sale (the “Terms”) govern all sales of products and gift vouchers made through the website www.travelmarketlondon.com (the “Site”), operated by Travel Market Ltd, a company incorporated in England and Wales under company number 17340349, whose registered office is at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom (the “Seller”).
By placing an order on the Site, the customer (the “Customer”) agrees to be bound by these Terms without reservation.
Article 1 — Purpose and Scope
1.1 These Terms set out the conditions under which the Seller sells, at a distance, travel accessories (passport holders, travel pillows, suitcases and similar items, the “Products”) and gift vouchers (the “Gift Vouchers”).
1.2 These Terms apply to every order placed by a Customer, whether a consumer or a business, on the Site, regardless of delivery country, subject to the delivery restrictions set out in Article 6.
1.3 The Seller reserves the right to amend these Terms at any time. The Terms applicable to an order are those in force on the date the order is placed.
Article 2 — Products
2.1 Products offered for sale are presented on the Site with descriptions and images that are as accurate as reasonably possible. The Seller cannot be held responsible for minor colour or finish variations arising from the Customer’s display settings.
2.2 Products are offered subject to availability. If a Product becomes unavailable after an order is placed, the Customer will be informed as soon as reasonably possible and may choose a full refund, a substitute product, or to wait for restocking.
Article 3 — Orders
3.1 The Customer places an order directly on the Site by following the checkout process (selecting Products, confirming the basket, entering delivery and payment details).
3.2 An order is only final once payment has been confirmed. A confirmation email summarising the order is sent to the Customer at the email address provided.
3.3 The Seller reserves the right to cancel or refuse any order that appears abnormal or fraudulent, or where there is an unresolved dispute with the Customer.
Article 4 — Price and Payment
4.1 Prices are shown in pounds sterling (GBP), inclusive of applicable taxes. Delivery is complimentary worldwide; any exceptional delivery charge is always shown before the order is finalised.
4.2 The Seller reserves the right to change its prices at any time; Products are invoiced on the basis of the price in effect at the time the order is confirmed.
4.3 Payment is made online using the payment methods offered on the Site. Orders are only processed once payment has been received in full.
4.4 The Site uses secure payment processing. The Seller does not, at any point, store the Customer’s card details, which are handled exclusively by the payment provider.
Article 5 — Right to Cancel, Returns and Refunds
5.1 Cancellations, returns and refunds are governed by our separate Returns & Refunds Policy, available on the Site, which forms part of these Terms by reference.
Article 6 — Delivery
6.1 Products are delivered to the address provided by the Customer when ordering, within the geographic areas specified on the Site.
6.2 Delivery times shown at checkout are indicative. A reasonable delay in delivery shall not give rise to any liability on the part of the Seller or any right to compensation.
6.3 Risk in the Products passes to the Customer upon delivery, once the Product is handed to the Customer or a third party nominated by the Customer.
6.4 Where a Product is visibly damaged on delivery, the Customer must note this with the carrier and inform the Seller as soon as reasonably possible.
Article 7 — Gift Vouchers
7.1 The Site offers Gift Vouchers for sale, redeemable exclusively for the purchase of Products on the Site. Gift Vouchers are non-refundable and cannot be exchanged or converted into cash, in whole or in part, at any time.
7.2 Gift Vouchers purchased on the Site do not carry an expiry date and remain valid until fully redeemed.
7.3 Where the value of a Gift Voucher exceeds the price of the Product(s) purchased, the difference is never returned in cash or by any means equivalent to a cash conversion. The difference is credited exclusively as a remaining balance on the Gift Voucher, or as a new Gift Voucher of the same nature, to be used against a future purchase of Products on the Site.
7.4 Gift Vouchers may not be resold or transferred for consideration. A Gift Voucher may be redeemed by any person holding the associated code; the Seller cannot be held liable if a Customer loses a code or discloses it to a third party.
7.5 Where an order paid, in whole or in part, with a Gift Voucher is cancelled or refunded, the corresponding amount is credited to a new Gift Voucher, unless otherwise required by law.
7.6 The Seller reserves the right to suspend the use of a Gift Voucher where fraud is suspected, without prejudice to the rights of the legitimate holder.
Article 8 — Statutory Guarantees
8.1 In accordance with the Consumer Rights Act 2015, Products sold must be as described, of satisfactory quality, and fit for their intended purpose.
8.2 Where a Product does not conform, the Customer may request a repair, replacement, price reduction, or refund of the Product concerned, subject to the conditions set out in the applicable legislation.
8.3 These statutory guarantees apply independently of any commercial guarantee that may be offered by the Seller or manufacturer.
Article 9 — Liability
9.1 The Seller shall not be liable for any failure or delay in performing its obligations caused by force majeure, the act of a third party, or fault on the part of the Customer.
9.2 In any event, the Seller’s liability is limited to the value of the order concerned, except in the case of gross negligence, wilful misconduct, or personal injury.
9.3 The Seller shall not be liable for any indirect loss arising from use of the Site or the Products.
Article 10 — Data Protection
10.1 The Seller processes the Customer’s personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
10.2 Data collected is used to process orders, manage the customer relationship, and, subject to the Customer’s consent, to send marketing communications.
10.3 The Customer has the right to access, rectify, erase, and object to the processing of their personal data, which may be exercised by contacting the Seller using the details provided on the Site.
Article 11 — Intellectual Property
11.1 All elements of the Site (text, images, logos, trade marks, graphic elements) are the exclusive property of the Seller or its partners.
11.2 Any reproduction, representation, or exploitation, in whole or in part, of these elements without the Seller’s prior written consent is prohibited.
Article 12 — Complaints and Disputes
12.1 For any complaint, the Customer may contact the Seller’s customer service using the details provided on the Site.
12.2 These Terms are governed by the laws of England and Wales. Any dispute relating to their interpretation or performance shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory rights available to consumers resident elsewhere.
Article 13 — Miscellaneous
13.1 Should any provision of these Terms be held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13.2 The Seller’s failure to enforce any provision of these Terms at any time shall not be construed as a waiver of the right to enforce it thereafter.
